NIKO8 PERFORMANCE / NIKOSPACE

PARTICIPANT WAIVER & RELEASE OF LIABILITY

1. ASSUMPTION OF RISK. I understand that dance, movement, choreography, theater, rehearsals, workshops, physical conditioning, and studio use involve inherent risks, including slips, falls, collisions, physical exertion, muscle strains, fractures, other injuries, property damage, and, in rare circumstances, death. I voluntarily choose to participate, assume the ordinary and inherent risks of these activities, and accept responsibility for determining my physical ability to participate.

2. RELEASE OF LIABILITY. To the fullest extent permitted by Illinois law, I release Niko8 Performance, NikoSpace, and their owners, directors, officers, employees, instructors, choreographers, contractors, agents, volunteers, and representatives (collectively, the “Released Parties”) from claims, demands, damages, losses, and expenses arising from my participation or presence at the studio, including claims for personal injury, death, or property loss and claims based on ordinary negligence, to the extent legally waivable. This release does not cover liability that cannot legally be waived, including willful and wanton misconduct where a release is prohibited by law.

3. INDEMNIFICATION. To the fullest extent permitted by law, I agree to indemnify, defend, and hold harmless the Released Parties against third-party claims, damages, liabilities, and reasonable legal expenses arising from my negligent, reckless, or intentional conduct, my violation of studio rules or this Agreement, or damage I cause to studio property, to the extent attributable to my conduct or other circumstances for which I am legally responsible.

4. SAFETY, PROPERTY & CONDUCT. I agree to follow Niko8 safety instructions, use equipment responsibly, respect other participants, report injuries and hazards, and comply with studio rules and occupancy limits. I am responsible for securing my personal belongings. Niko8 may remove me from activities or revoke my access for unsafe, unauthorized, or inappropriate conduct.

5. MEDICAL EMERGENCIES. I authorize Niko8 representatives to contact emergency services and assist in obtaining emergency care when reasonably necessary. I understand I am responsible for my medical expenses and that Niko8 does not provide medical insurance.

6. SCOPE & ACKNOWLEDGMENT. This Agreement applies to the activities described above and subsequent Niko8 activities for which it is accepted, to the extent permitted by law. It is governed by Illinois law. If any provision is unenforceable, the remaining provisions remain effective to the extent permitted by law. I have read and understood this Agreement, understand that it releases certain legal claims, have had the opportunity to ask questions and seek independent legal advice, and sign voluntarily.
